1. Acceptance of Terms

By accessing or using the Shortcut Reviews platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

2. Description of Service

Shortcut Reviews provides a platform that enables service businesses ("Subscribers") to send SMS review requests to their customers ("End Users"). The Service facilitates the collection and management of customer reviews.

3. Subscriber Accounts

Subscribers are responsible for maintaining the confidentiality of their account credentials. Subscribers agree to provide accurate and complete information when creating an account and to update that information as needed.

4. Acceptable Use

Subscribers agree to:

  • Only send review requests to customers with whom they have a legitimate, recent service relationship

  • Not use the Service to send unsolicited messages, spam, or marketing content unrelated to review collection

  • Comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act

  • Not misrepresent their identity or business when using the Service

5. SMS Messaging Terms

  • Messages are sent to End Users on behalf of Subscribers through the Shortcut Reviews platform.

  • Message frequency varies. Typically, one message is sent per service interaction.

  • Message and data rates may apply.

  • End Users can opt out at any time by replying STOP to any message.

  • For help, End Users can reply HELP to receive support information.

  • Shortcut Reviews uses Twilio as its SMS delivery provider. By using the Service, Subscribers acknowledge and agree to Twilio's Acceptable Use Policy.

6. Fees and Payment

Subscribers agree to pay all applicable fees associated with their subscription plan. Fees are billed on a recurring basis as specified at the time of signup. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of access to the Service.

7. Reviews and Content

End Users retain ownership of the review content they submit. By submitting a review, End Users grant Shortcut Reviews and the associated Subscriber a non-exclusive, royalty-free license to display and use the review in connection with the Subscriber's business.

Subscribers are responsible for how they use and display reviews collected through the Service.

8. Prohibited Content

Users may not submit or transmit content that is unlawful, defamatory, harassing, threatening, obscene, or otherwise objectionable. We reserve the right to remove any content that violates these Terms.

9. Intellectual Property

All content, trademarks, and technology associated with the Shortcut Reviews platform are owned by Shortcut Reviews. Subscribers and End Users may not copy, modify, distribute, or reverse-engineer any part of the Service.

10. Limitation of Liability

To the fullest extent permitted by law, Shortcut Reviews shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability for any claim shall not exceed the amount paid by the Subscriber in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

We may suspend or terminate access to the Service at any time for violations of these Terms or for any other reason at our discretion. Subscribers may cancel their account at any time. Upon termination, the Subscriber's right to use the Service ceases immediately.

13. Indemnification

Subscribers agree to indemnify and hold harmless Shortcut Reviews from any claims, losses, or damages arising from the Subscriber's use of the Service, including any violation of these Terms or applicable law.

14. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts located in San Diego County, California.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will notify Subscribers of material changes via email.
